Apostille

Apostille is a clause which proves the authenticity of the signature and of the document. It is being connected to official documents. In certain situations represents legalization.

The document does not need to be verified by the embassy of the country in which the document is to be subsequently used (abroad). It is issued in the country in which the document was created, usually by a special apostille authority. For example, here in the Czech Republic, this verification is carried out by the Ministry of Foreign Affairs of the Czech Republic.

It should be noted that this verification clause does not confirm the content of the document itself. It always verifies the authenticity of the signature, the person signing, the authority, and possibly also the authenticity of the stamp or seal.

Apostille is issued in the official language of issuing state but for purpose of using the document abroad has to be translated into official language in the country of use.

THE HAGUE CONVENTION AND APOSTILLE

The use of the apostille clause is limited to states that have become part of the Convention on the Abolition of Requirements for the Authentication of Foreign Public Documents. This Convention on the Abolition of Requirements for Authentication of Foreign Public Documents was adopted in The Hague on October 5, 1961 (the so-called Hague Convention). An apostille is issued in the official language of the state, but it is necessary that this document be translated into another language as well.

In most cases, however, the apostille clause is also bilingual. In that case, it is mostly the English language. Even so, in most cases it is necessary to have the verification clause translated by a court (for example, for the Czech Republic).

The aim of this Convention on the abolition of requirements for the verification of foreign public documents was primarily to simplify the process of so-called superlegalization and to work more effectively with foreign documentation with international validity.
